In the last decade, a number of automobile manufacturers have recalled their vehicles due to faulty seatbacks. Ford, Audi, Toyota, Mercury, Tesla, and Nissan have all issued recalls because of failures in their seats in recent years. In 2018, Honda recalled 800,000 Odyssey minivans because the seats were not properly latched and could tip forward.
Litigation in the past few years has suggested that backseat passengers can still face significant danger due to defects in car seats. Defective seat backs may not always be able to withstand the impact of a collision and can result in devastating injuries.
This becomes particularly more alarming when you consider the years of expert recommendations advising parents to put children in the back of the car for the safety and well-being of children.

In 2016, a Texas jury awarded $124.5 million to a family after their 7-year old son was severely injured during a car wreck. The boy was sitting behind his father in an Audi sedan when the car was rear-ended. The driver’s seat broke, which propelled the father into his son. The 7-year-old now suffers from permanent brain damage and partial paralysis.
The National Highway Traffic Safety Administration said they have looked into the issue, but it’s very challenging to upgrade the standard because accidents like these are rare.
